Purple Bytes Ownership

Purple Bytes retains ownership of:

• Internal development frameworks

• Reusable code libraries
• Templates
• Internal automation systems
• Tools and processes developed independently of the project

These may be reused in future projects.

9. Third-Party Software & Services

Projects may use third-party products including:

• Hosting providers
• Domain registrars
• Payment gateways
• Plugins
• APIs
• SaaS platforms
• Cloud providers
• Advertising platforms

Clients are responsible for maintaining valid licenses, subscriptions, or accounts where required.

Purple Bytes is not responsible for service interruptions, pricing changes, or policy updates made by third-party providers.

10. Website Maintenance

Maintenance services are provided only under an active maintenance agreement.

Without an active maintenance plan, Purple Bytes is not responsible for:

• Plugin updates
• Security patches
• Website monitoring
• Backups
• Performance optimization
• Compatibility issues caused by outdated software

11. SEO & Digital Marketing Disclaimer

While we follow industry best practices, Purple Bytes cannot guarantee:

• Sales or revenue growth
• Advertising platform approvals

Digital marketing performance depends on many external factors, including competition, market conditions, search engine algorithms, and client participation.

12. Confidentiality

Purple Bytes treats client information as confidential.

Both parties agree not to disclose confidential business information unless:

• Necessary for project delivery through trusted partners

13. Data Protection

We take reasonable administrative, technical, and organizational measures to protect client information.

However, no online transmission or storage system can be guaranteed to be completely secure.

14. Limitation of Liability

To the fullest extent permitted by law, Purple Bytes shall not be liable for:

• Indirect losses
• Loss of revenue
• Loss of profits
• Business interruption
• Loss of data
• Loss of goodwill
• Consequential or incidental damages

Our total liability for any claim shall not exceed the total amount paid by the client for the specific service giving rise to the claim.

15. Warranties

Purple Bytes warrants that services will be performed with reasonable skill and care.

Except as expressly stated, all services are provided on an “as-is” and “as-available” basis without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, or uninterrupted operation.

16. Cancellation & Termination

Either party may terminate a project by providing written notice in accordance with the project agreement.

Upon termination:

• The client is responsible for payment of work completed up to the termination date.
• Purple Bytes may retain project files until outstanding invoices are settled.
• Refunds, if applicable, will be governed by the signed agreement.

17. Force Majeure

Purple Bytes shall not be held liable for delays or failures caused by events beyond our reasonable control, including but not limited to natural disasters, internet outages, government actions, labor disputes, cyberattacks, pandemics, or other unforeseen circumstances.
